Terms of Service

1. Acceptance of Terms
By accessing or using FunnelLeaks.app (the "Service"), operated by FunnelLeaks, LLC ("FunnelLeaks," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy, all of which are incorporated by reference. If you do not agree to these Terms, you may not access or use the Service. You must explicitly accept these Terms, our Privacy Policy, and Cookie Policy during account registration before the Service will be activated. We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
2. Description of Service
FunnelLeaks is a software-as-a-service (SaaS) platform that monitors marketing funnel pages for failures, errors, and performance issues. The Service includes real-time monitoring of landing pages, forms, and checkout flows through various check types including HTTP status monitoring, SSL certificate verification, page load speed analysis, tracking pixel detection, form validation, broken link scanning, and redirect chain analysis. The Service also integrates with third-party advertising platforms (including Google Ads and Meta Ads) to enable automated campaign management actions such as pausing ad campaigns when funnel failures are detected. Additional features, including multi-channel notifications, are planned for future release.
3. Account Registration and Security
To use the Service, you must create an account by providing accurate, current, and complete information. During registration, you must review and accept the current versions of our Terms of Service, Privacy Policy, and Cookie Policy. Your acceptance is recorded with a timestamp and your IP address for our records. No monitoring or automated actions will be performed on your behalf until you have completed this acceptance. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at security@funnelleaks.app of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or for security reasons.
4. Subscription Plans and Payment
4.1 Billing
The Service is offered through paid subscription plans with varying feature sets and usage limits. All prices are in U.S. dollars and are listed on our pricing page. Subscriptions are billed on a recurring monthly basis through Stripe, Inc., our payment processor.
4.2 Automatic Renewal
Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date. You authorize us to charge your payment method on file for each renewal period.
4.3 Cancellation Policy
You may cancel your subscription at any time through the Billing section of your account dashboard or by contacting support@funnelleaks.app. When you cancel, your subscription will remain active until the end of your current paid billing period. You will continue to have full access to all monitoring features and services through the remainder of the period you have already paid for. Once the current billing period ends, your subscription will not renew, all future payments will cease, and your monitoring service will be deactivated. No further charges will be made to your payment method after cancellation takes effect.
4.4 Refund Policy
All payments are non-refundable. No refunds or credits will be issued for any previously paid billing periods, partial months, or unused portions of your subscription. By subscribing, you acknowledge and agree that charges for completed billing periods are final. If you believe you have been incorrectly charged or have a billing dispute, please contact support@funnelleaks.app within 30 days of the charge for review.
4.5 Plan Changes
You may upgrade or downgrade your subscription plan at any time through the Billing section of your account dashboard. Upgrades take effect immediately with a prorated charge for the remainder of the current billing period. Downgrades take effect at the beginning of the next billing period. We reserve the right to modify pricing with 30 days advance notice.
5. Ad Platform Integrations and Automated Actions
5.1 Third-Party Ad Platform Access
The Service may connect to your advertising accounts on third-party platforms including but not limited to Google Ads and Meta Ads (Facebook/Instagram Ads). By connecting these accounts, you grant FunnelLeaks permission to access your campaign data, read campaign status and performance metrics, and take automated actions on your behalf as described below.
5.2 Automated Campaign Pausing
When the Service detects a critical failure in your monitored funnel (such as a broken page, failed form, or missing tracking pixel), it may automatically pause associated ad campaigns on your connected advertising platforms. This automated action is designed to protect your ad spend from being wasted on broken funnels. You acknowledge that: (a) automated pausing decisions are based on predefined failure thresholds and severity levels; (b) there may be a delay between failure detection and campaign pausing; (c) FunnelLeaks is not liable for any ad spend incurred during this delay or for any revenue impact from campaigns being paused; (d) you can configure which funnels are mapped to which ad campaigns; (e) you can disable automated pausing at any time through your account settings.
5.3 Ad Platform Data
When you connect an advertising platform, we may access and store campaign identifiers, campaign names, campaign status, and spend data solely for the purpose of managing automated actions. We do not access or store your ad creative content, audience targeting data, or billing information from these platforms. Your use of third-party advertising platforms remains subject to those platforms' own terms of service.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose or in violation of any applicable law; (b) attempt to gain unauthorized access to the Service, other accounts, or computer systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) use the Service to monitor websites you do not own or have authorization to monitor; (e) reverse engineer, decompile, or disassemble any part of the Service; (f) resell, sublicense, or redistribute the Service without written permission; (g) use the Service to send spam, phishing, or malicious content; (h) submit URLs containing illegal content for monitoring; (i) connect advertising accounts that you do not own or have authorization to manage.
7. Intellectual Property
The Service, including its original content, features, functionality, software, and design, is owned by FunnelLeaks, LLC and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws. The FunnelLeaks name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FunnelLeaks, LLC. You may not use these marks without our prior written permission. Your monitoring data and content remain your property; by using the Service, you grant us a limited license to process and display it as necessary to provide the Service.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal information and device data. By using the Service, you consent to the collection of device information (browser type, operating system, screen resolution, device type), behavioral data (pages visited, features used, session duration), and the use of cookies and similar tracking technologies as described in those policies.
9. Service Availability and Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will detect all possible funnel failures. While we strive for 99.9% uptime, scheduled maintenance and unforeseen issues may cause temporary interruptions. We do not guarantee the timeliness or accuracy of automated ad campaign actions. You are solely responsible for reviewing and managing your ad campaigns.
10. Limitation of Liability
To the maximum extent permitted by law, FunnelLeaks, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, ad spend, or business opportunities, arising from your use of or inability to use the Service, including but not limited to damages arising from automated campaign pausing actions or failure to pause campaigns. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless FunnelLeaks, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit through the Service; or (e) any actions taken by the Service on your connected advertising platforms pursuant to your configuration.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease, all automated monitoring and ad campaign actions will stop, and connected advertising platform integrations will be disconnected. Sections related to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
